Terms of Service

1.1 The Platform: Trip Express is an online marketplace that connects users with third-party suppliers ('Operators') of travel experiences, tours, tickets, and other services ('Activities').
1.2 Our Role: We act predominantly as an agent for the Operators. We are not the supplier of the Activities unless explicitly stated. Upon booking, you enter into a direct contractual relationship with the Operator.
1.3 Eligibility: You must be at least 18 years old and possess the legal authority to enter into this agreement. By using the Platform, you warrant that all information you supply is true and accurate.

2.1 Account Creation: You may need to register an account to access certain features. You agree to provide accurate, current, and complete information.
2.2 Security: You are responsible for safeguarding your password. You agree to notify us immediately of any unauthorized use of your account. Trip Express will not be liable for any loss that you may incur as a result of someone else using your password or account.
2.3 Identity Verification: We reserve the right to ask for proof of identity (e.g., passport copy) to prevent fraud and comply with anti-money laundering (AML) laws.

3.1 Booking Process: Your booking is confirmed only when you receive a confirmation email with a voucher. Until then, the booking is provisional.
3.2 Pricing: Prices are dynamic and may change based on demand, exchange rates, and Operator adjustments. The price is locked only upon successful payment.
3.3 Currency: You may view prices in various currencies. If you pay in a currency different from your card's base currency, your issuer may charge conversion fees. Trip Express is not responsible for these fees.
3.4 Taxes: Unless specified otherwise, prices include applicable VAT/GST. Note that some destinations may charge local city taxes payable directly at the venue.

4.1 Standard Cancellation Policy: Unless the specific activity page states otherwise:
- Free Cancellation: Up to 24 hours before the activity start time.
- Non-Refundable: Within 24 hours of the start time.
4.2 Operator Cancellations: If an Operator cancels due to weather, safety, or force majeure, you will be offered a reschedule or a full refund.
4.3 No-Shows: If you fail to appear at the meeting point on time, no refund will be issued.

5.1 License: By posting reviews, photos, or comments ('User Content'), you grant Trip Express a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, reproduce, and translate such content across our marketing channels.
5.2 Prohibited Content: You agree not to post content that is false, defamatory, infringing, or violates our Community Guidelines. We reserve the right to remove any content at our sole discretion.

You agree NOT to:
- Use any robot, spider, scraper, or other automated means to access the Platform.
- Bypass or ignore measures used to prevent or restrict access.
- Take any action that imposes an unreasonable load on our infrastructure.
- Make speculative, false, or fraudulent bookings.

All content on the Platform (text, graphics, logos, software) is the property of Trip Express or its licensors and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Platform without written permission.

THE PLATFORM AND SERVICES ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. TRIP EXPRESS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIP EXPRESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS OR DATA) ARISING OUT OF YOUR USE OF THE PLATFORM. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD 100.00.

You agree to defend, indemnify, and hold harmless Trip Express, its affiliates, and agents from any claims, liabilities, damages, losses, and expenses arising out of your access to the Platform, your violation of these Terms, or your infringement of any third-party rights.

Trip Express shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, or strikes.

12.1 Binding Arbitration: Any dispute arising under these Terms shall be resolved by binding arbitration administered by the Singapore International Arbitration Centre (SIAC).
12.2 Class Action Waiver: You waive the right to participate in a class action lawsuit or class-wide arbitration.
12.3 Governing Law: These Terms are governed by the laws of Singapore, without regard to conflict of law principles.
